Adverse Possession
Monday, March 1, 2010 at 10:56PM The pretender lenders are facing increasing opposition by homeowners. Since they know they can’t win in a court of law, servicers and pretender lenders are going around the law to take people properties. They are sending so called “property preservation” companies to harass homeowners and tenants. If the property is vacant, they will break in a change the lock. They did exactly that with two of my units. I went back and change the lock and filed a police report.
One of my tenant said she is getting monthly visit from individuals pretending to own my property. They are threatening her with eviction. I told my tenants that they are trying to intimate them; in either case, they are protected by the Federal law that requires new owners to honor existing lease. It is despicable to see such a display of total disrespect for the law. Don’t be intimidated by these hooligans. The law is on your side; it is your property.

The solution to ensuring a good faith mortgage negotiation is to calculate an unbiased Net Present Value using bank software so that the lender can't dispute the calculations. The REST Report does exactly that and has been sanctioned by every single judge who has ruled on it. The software always recommends modification or short sale since those solutions benefit the mortgage investor and homeowner the most.
